Terms and Conditions

Effective Date: November 26, 2025 By accessing or using https://www.freedomstate.us (the “Website”), listening to “The State of Freedom” podcast (the “Podcast”), purchasing tickets to events, becoming a paid member, or making any donation, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, please do not use the Website or any related services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and The State of Freedom, LLC (or the applicable legal entity operating the Podcast, collectively referred to as “we,” “us,” “our,” or “The State of Freedom”). We may update these Terms from time to time. The updated version will be posted on this page with a new “Effective Date.” Your continued use of the Website or services after any changes constitutes your acceptance of the new Terms.

2. Description of Services

The Website and related services include:

  • Free and paid podcast episodes

  • Donation functionality

  • Event registration and ticketing (when available)

  • Paid membership portal with exclusive content and benefits

  • Email newsletters and community features

3. Eligibility
You must be at least 13 years old to use the Website. If you are under 18 (or the age of majority in your jurisdiction), you may only use the Website under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
4. Donations

  • Donations to The State of Freedom are voluntary and non-refundable.

  • Donations do not entitle you to any goods, services, or ownership interest in the Podcast or its operators unless explicitly stated.

  • We use third-party payment processors (e.g., Stripe, PayPal, etc.). You agree to their terms and privacy policies when making a donation.

  • Donors may receive certain non-monetary perks (e.g., shout-outs, bonus content) at our sole discretion, but these are gratitude gifts are not guaranteed and have no cash value.

5. Paid Memberships & Subscriptions

  • Certain content, episodes, community access, or features are available only to paid members.

  • Memberships are billed on a recurring basis (monthly or annually) until canceled.

  • You may cancel your membership at any time via your account settings or by contacting us. Cancellation takes effect at the end of the current billing cycle.

  • No refunds or prorated refunds will be issued for partial months or years.

  • We reserve the right to change membership pricing or benefits with reasonable advance notice.

6. Events & Ticketing

  • When we host live or virtual events, tickets are sold on a non-refundable basis unless the event is canceled or rescheduled by us.

  • In case of cancellation by us, we will offer a full refund or credit toward a future event at our discretion.

  • Ticket holders agree to any additional event-specific rules or policies posted at the time of purchase.

7. Intellectual Property
All content on the Website and in the Podcast (including but not limited to audio, video, text, logos, graphics, and images) is owned by The State of Freedom or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material without our prior written consent, except:

  • Your computer may temporarily store copies for personal use.

  • You may share individual episodes via official sharing tools (e.g., embed players, social media buttons).

8. User Conduct
You agree not to:

  • Use the Website or services for any unlawful purpose

  • Impersonate any person or entity

  • Harvest or collect personal information about other users

  • Interfere with the operation of the Website or services

  • Upload or transmit viruses or malicious code

9. Disclaimer of Warranties
The Website, Podcast, and all related services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, The State of Freedom, its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Website or services.
11. Indemnification
You agree to defend, indemnify, and hold harmless The State of Freedom and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your violation of these Terms or your use of the Website or services.
12. Termination
We may suspend or terminate your access to the Website, membership, or any services at any time, with or without cause or notice, including if we believe you have violated these Terms.
13. Governing Law & Jurisdiction
These Terms shall be governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any legal action arising out of these Terms or your use of the Website shall be brought exclusively in the state or federal courts located in Terrebonne Parish, East Baton Rouge Parish and Louisiana.
14. Dispute Resolution

Any dispute arising out of these Terms or your use of the Website shall first be attempted to be resolved informally. If not resolved within 30 days, the dispute shall be settled by binding arbitration in East Baton Rouge, LA in accordance with the rules of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

15. Miscellaneous

  • These Terms constitute the entire agreement between you and The State of Freedom.

  • If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect.

  • Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
